At eBusStation we strive to ensure that all the needs of all our customers are fulfilled to a very high standard. We understand that from time to time circumstances change and we try to resolve each situation to a resolution that is satisfactory to each party involved. Please note that as our business evolves and grows, we may amend our terms and conditions. We advise all users to refer to this page frequently for any updates.

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Ireland. This Agreement constitutes the entire agreement and understanding between the parties with respect to their subject matter, and except as expressly provided, supersedes all prior representations, writings, negotiations or understandings with respect to that subject matter.

1. Definitions
1.1 “eBusStation” is a third party booking site connecting customers looking to book a private bus or coach with Private Bus Operators. eBusStation is a trading name of Oakhampton Limited.
1.2 “Customers” means any individual group or person acting on behalf of any group looking to book/hire a private coach or bus for any type of occasion. When the booking is made, the group travelling on the trip becomes the customer.
1.3  “Bus Operators” means any individual or registered company who has a Road Passenger Transport Operator’s Licence if you are carrying passengers by road for hire or reward in vehicles constructed and equipped so as to be suitable for carrying nine or more passengers.  Some Bus Operators may have vehicles that are under 9 seats which are classified as a hackney or taxi by the Department of Transport.
1.4  “LPSV Licence” is also known as Large Public Service Vehicles refers to the licence number attached to each vehicle that is registered under the Bus Operators Road Passenger Transport Operator’s Licence.
1.5  “SPSV Licence” is also known as Small Public Service Vehicles and is given to vehicles with 8 seats or less that operates as a hackney or taxi for hire or reward.

 

2. Our Liability
2.1  eBusStation is a third party company that connects customers looking to book a private bus or coach with private bus operators in the Republic of Ireland.
2.2  All Insurances and other vehicle certification and responsibilities are that of the Bus Operator. We advise all customers to check that the bus operator has the necessary insurances and other vehicle certification and responsibilities in place in advance of their trip(s).
2.3  eBusStation is not responsible for any of the following;
2.3.1 Any accident, injury or altercation that may occur between any Bus Operator and any customer. eBusStation will keep a record of any complaint made directly to us and may contact either party to advise of such complaint. We reserve the right to suspend or cancel any customer or Bus Operators account.
2.3.2 Bus Drivers; It is the Bus Operators responsibility to ensure that they have done all the necessary checks in relation to each driver. It is not eBusStations responsibility to do these checks and eBusStation is not responsible for any altercation that may occur between the Bus Driver and the Bus Operator or the Bus Driver and the Customer. Where we feel it’s necessary, eBusStation may from time to time report any incidences that occurs on a bus to the Bus Operator. If we identify continuous complaints about a bus driver or bus operator, we reserve the right to suspend or cancel the bus operators account. It is the bus operators’ responsibility to ensure that their bus driver(s) are informed fully on the procedures related to their safety.
2.3.3 Bus Housekeeping; It is the responsibility of each Bus Operator to ensure that each of their vehicles are kept clean and tidy. Any complaints that customers have in relation to this is between them and the Bus Operator. If there are continuous complaints made by customers to eBusStation, we will contact the Bus Operator. If we receive more complaints after we have contacted the operator, we reserve the right to cancel or suspend the operators account.
2.3.4 Abusive Customers; Each Bus Operator has a policy on how to handle an abusive customer(s) or groups that are abusive.  Any complaint or disputes that arise from this is between the bus operator/driver and the customer(s) or group.
2.3.5 Health & Safety; Each Bus Operator is responsible for Health & Safety and any regulations or procedures related to Health & Safety for his/her business.
2.4  eBusStation exchanges the details to both parties after the “customer” picks a suitable “Bus Operator” and the booking deposit has been paid. When these details are exchanged, the contract is between the “Customer” and the “Bus Operator”. eBusStation has no liability for any changes made to the booking after this.
2.5  When the Bus Operator registers, eBusStation checks their Road Passenger Transport Operator’s Licence Number and any Small Public Services Vehicles Number (SPSV), to ensure that their licence is valid and up to date. It is the Bus Operators responsibility to ensure that they renew their licence before it is due to expire.
2.6  eBusStation has no liability for any trip being fulfilled by operators who are using an expired Road Passenger Transport Operator’s Licence Number and (or) a Small Public Services Vehicles Number (SPSV), or with buses or vehicles that are not legally registered. It is up to individual operators to ensure that their business and their buses are legally registered to operate.
2.7  eBusstation reserves the right to cancel any customers or Bus Operators account due to a complaint or a number of complaints being made.

3. Customers
3.1  “Customer” means any person, group or individual acting alone or on behalf of a group, club, society, learning centre, hotel group or company looking to book/hire a coach or bus for any occasion. In other words, anyone looking to book any coach or bus or any type of event or social outing.
3.2  After the booking fee is paid, eBusStation will exchange the details of each party via uploads to the customers and Bus Operators account/dashboard. eBusStation will also notify each party by email. From this point on, the contract is between the Customer and the Bus Operator.
3.3  We advise all customers to check with their selected bus operator to ensure that they have all the necessary insurance and vehicle documentation in place before they travel with them.
3.4  Although eBusStation endeavours to check all Bus Operators Road Passenger Transport Operator’s Licence and Hackney or Taxi Licence numbers, it is the Bus Operators responsibility to ensure that their licence has been renewed and is in date. eBusStation is not liable or does not take responsibility for any Bus Operator or bus drivers’ legal documentation.
3.5  eBusStation is not responsible for any time changes, disputes, cancellations or accidents that occur on, during or after the trip.
3.6  If the bus breaks down on or during trip, it is the Bus Operators responsibility to put the necessary measures in place to ensure the trip is fulfilled.
3.7  eBusStation reserves the right to suspend or cancel any customers account.

 

4. Bus Operators
4.1 Bus Operators need a Road Passenger Transport Operator’s Licence if they are carrying passengers by road for hire or reward in vehicles constructed and equipped so as to be suitable for carrying nine or more passengers.
4.2 If any individuals or Bus Operators are using a vehicle to carry passengers for hire or reward with 8 seats or less, you are deemed by law to be a Taxi or Hackney and you must have the relevant SPSV vehicle licence (s) in place. It’s the Bus Operators’ responsibility to keep their Road Passenger Transport Operator’s Licence and  SPSV licences and all associated vehicles up to date so they can legally conduct business. It is not eBusStations responsibility to remind Bus Operators of any legal requirements, however eBusStation reserves the right to suspend or cancel any Bus Operators account they find to be in breach of their legal requirement to conduct business.
4.3  eBusStation determines “Bus Operator” to mean a person or company that legally holds an up to date Road Passenger Transport Operator’s Licence or Hackney or Taxi licence which states how many large and small public vehicles are registered to conduct business. It is the Bus Operators’ responsibility to keep their Road Passenger Transport Operator’s Licence or Hackney or Taxi licence and all associated vehicles up to date so they can legally conduct business. It is not eBusStations responsibility to remind Bus Operators of any legal requirements, however eBusStation reserves the right to suspend or cancel any Bus Operators account they find to be in breach of their legal requirement to conduct business.
4.4  When registering on eBusStation, all Bus Operators must register their details in the “utmost good faith”. Failure to do so may result in eBusStation suspending or cancelling their account.
4.5  The Bus Operator must enter their Road Passenger Transport Operator’s Licence or Hackney or Taxi Licence Number as part of the registration process.
4.6  The Bus Operators account will only become active by eBusStation after their Road Passenger Transport Operator’s Licence or Hackney or Taxi Licence Number has been checked and verified by eBusStation. It is the Bus Operators responsibility to ensure that their Road Passenger Transport Operator’s Licence or Hackney or Taxi Licence Number is up to date and renewed when required.
4.7  If eBusStation finds a Bus Operator failed to renew their Road Passenger Transport Operator’s Licence or Hackney or Taxi Licence Number, their account with eBusStation is immediately suspended. eBusStation will notify the Bus Operator that their account is suspended and eBusStation will contact any customer with outstanding future bookings made through with this Bus Operator. eBusStation will help to get these bookings fulfilled by an alternative Bus Operator. In this circumstance, if an alternative Bus Operator cannot be found, eBusStation will refund any monies paid by the customer to eBusStation less administration costs.
4.8  eBusStation does not tolerate poaching of business or potential business or leads that is given to Bus Operators through our website. Operators found to be in breach of this may have their account suspended or cancelled upon further investigation.
4.9   eBusStation does now allow for any form of unsolicited advertisement from Bus Operators when they are quoting for business through eBusStation. This includes and is not limited to pictures of their company name and contact number shown by Bus Operators on their profiles and submitting their contact detail in any form as part of the quote process. eBusStation views this as being a serious breach of our terms and condition and may result in Bus Operators account being suspended and or cancelled.

5. LPSV Licence (Large Public Service Vehicles)
5.1  It is the Bus operators responsibility to have the appropriate LPSV Licence in place on any vehicle(s) being used under their Road Passenger Transport Operator’s Licence.
5.2  While eBusStation will endeavour to check all Road Passenger Transport Operator’s Licences, it is the Bus Operators responsibility to keep their LPSV Licence and any vehicles they use are up to date.
5.3  eBusStation encourages all customers to check that the Bus Operators Road Passenger Transport Operator’s Licence and the appropiate LPSV Licence attached to the vehicle being used and other details are up to date before taking a trip.

6. SPSV  Licence (Small Public Service Vehicles)
6.1  The National Transport Authority is responsible for the licensing and regulation of small public service vehicles (SPSVs) in Ireland. This refers collectively to taxis, wheelchair accessible taxis, hackneys, wheelchair accessible hackneys and limousines.
6.2  SPSVs are defined as vehicles capable of carrying for hire or reward a maximum of eight passengers in addition to the driver.
6.3  It is the Bus operator’s responsibility to have the appropriate SPSV Licence in place on any vehicle(s) being used under their SPSV Licence.
6.4  While eBusStation will endeavour to check all SPSV Licences, it’s the Bus Operators responsibility to keep their SPSV Licence up to date and other details are up to date.
6.5  eBusStation encourages all customers to check that the Bus Operators SPSV Licence and other details are up to date before taking a trip.

7. Vehicles
7.1  eBusStation does not own any of the vehicles registered on the website. Any vehicle used for any trip booked through eBusstation is the responsibility of the registered Bus Operator.
7.2  It is the bus operator’s responsibility to make sure that their vehicle(s) are road worthy, have the appropriate insurance and documentation and any other requirements by law to operate in the Republic of Ireland or Internationally.
7.3  It is the Bus Operator’s responsibility to make sure that their vehicle(s) are clean and tidy.
7.4  eBusStation is a third party booking site. Any accident, incident or dispute is between the Bus Operator and the Customer/Group that has made the booking.
7.5  Continuous complaints about various issues related to Bus Operators vehicle(s) may result in the operators account being suspended or cancelled.

8. Payments
8.1  eBusstation will use Stripe secure payment platform to process all payments through our website.
8.2  eBusStation charges 15% booking/commission fee on all trips booked through eBusStation. This money is paid by the customer to eBusStation after they have selected the appropriate operator. eBusstation will then pass the details to each party involved and the balance (Cost of the trip minus 15%) is paid by the customer to the operator. This is capped at €65.
8.3  After eBusStation has passed the details to each party involved in the booking, it is the Bus Operator’s responsibility to agree with the customer when the balance is paid and the booking will now fall under the Bus Operators terms and conditions.
8.4  eBusStation does not collect any money on behalf of the Bus Operators. If this policy changes, it will be reflected on our Terms & Conditions.

9. Money Back
9.1  Any group, club, school, university, societies or voluntary organisations can apply for money back in relation to some of the booking fee.
9.2  ebusStation has the final say in determining who qualifies for this money back.
9.3  To qualify for this money back, at least 5 trips must be fulfilled through eBusStation in a 12-month period
9.4  eBusStation will give 2% of the booking fee/deposit back (Subject to a maximum, ref 9.2) to clubs, societies, universities, and schools that continuously book their bus through eBusStation. For Example; Trip Cost = €250. Money back = €250 x 2% = €5 per trip
9.5  eBusStation has a cap of €65 Booking Fee/Deposit. When a trip is booked and reaches the cap of €65, the maximum that will be given back to clubs, societies, universities, and schools that continuously book their bus through eBusStation will be €8.70 per Trip
9.6  eBusStation will pay this money annually through a Bank Transfer. The date will be determined by eBusStation.
9.7  eBusStation will not dedicate how the money should be spent but may request a photo shoot with selected recipients of the money back to be used by eBusStation for marketing purposes.
9.8  Individuals responsible for booking buses for various groups within clubs, societies, universities or schools can use their own email address to register and receive quotes. For their club, society, university or school to get the money back annually, they must mention their club, society, university or school when they are registering.
9.9  eBusStation will total all trips booked by individuals under each club, society, university or school and give this money back annually on a date determined by eBusStation.

10. Refunds
10.1  All booking fees paid are non-refundable
10.2  The following are the cancellations policy that applies;
10.2.1  Cancelation at any time –The booking fee paid to eBusStation is non-refundable.
10.1.2  After the booking fee is paid, the balance is paid to the Bus Operator as per their terms and conditions. Therefore, the cancellation policy after the booking fee is paid is between the Bus Operator and the customer. eBusstation does not get involved in any dispute that may arise from this.
10.4  Any payment made directly to the Bus Operator in advance of a planned trip is deemed to fall within the contract agreement between the Bus Operator and the Customer. Therefore, the Bus Operator’s refund policy will apply and any disputes that arise are between the Bus Operator and the Customer.

11. Complaint/Dispute Procedure
11.1  Any disputes, controversy or claim arising out of or in connection with this Agreement shall be settled by arbitration. The place of arbitration shall be Limerick, Ireland. The language to be used in the arbitral proceedings shall be English. The Arbitration Tribunal shall consist of a single arbitrator appointed by agreement between the parties or, failing agreement between the parties within 30 days after a request for arbitration is made by any party, appointed on the application of any party by the President for the time being of the Law Society of Ireland.
11.2  eBusStation does not get involved in any disputes that arise between customers and Bus  Operators after the booking is complete.
11.3  eBusStation encourages customers and Bus Operators to notify us through either customer feedback or by email of any complaint or disputes they may have.  Several complaints about customers or Bus Operators may result in their account being suspended or cancelled.
11.4  If a customer or a Bus Operator has any complaint related to the eBusStation website, please notify us by email at info@ebusstation.ie or through the Contact Us page on our website.  eBusStation will try to resolve all disputes to the customers and Bus Operators satisfaction in a timely manner.

12. Feedback & Surveys
12.1  After every completed trip, eBusStation will send customers feedback questions on how they rate their experience. This rating will be done on a 1-5 rating scale.
12.2  Initially this information will not be made public. However, eBusStation will send this feedback to the Bus Operator and it is up to the Bus Operator what they do with any information given to them related to their business.
12.3  eBusStation reserves the right to make this rating public at any stage.
12.4  From time to time we may contact customers and Bus Operators with the purposes of completing a survey.
12.5  The information from these surveys will be strictly confidential and will be used by eBusStation only and for the purposes of improving user experience on the website.
